The Public Defender's Office in UNICEF's “Active School Search”: inter-institutional coordination and implementation of Public Education Policy within the Public Defender's Office of the State of Rondonia

SUMMARY:

This research examines the role of the Public Defender's Office of the State of Rondonia in identifying and combating school dropout, considering its constitutional function of providing comprehensive legal assistance to vulnerable populations, as well as the right to education, which is constitutionally recognized as a social right linked to the promotion of citizenship and equality. In this context, the Public Defender’s Office has the potential to identify and act against school dropouts, particularly among children and adolescents in situations of social vulnerability. The research begins with the impact of the COVID-19 pandemic, when 1.4 million children and adolescents did not attend school, and another 4.1 million were unable to access remote schooling activities, according to data from the 2020 National Household Sample Survey. In this context, the “Active Search in Partnership with the Public Defender’s Office” project proposes integrating the Public Defender's Office into the Active School Search platform, already in operation in Rondonia, developed by the United Nations Children’s Fund (UNICEF) to identify and address cases of school dropout. The project aims to include Public Defender advisors as “community agents” who, during their assistance to vulnerable populations, will ask: “Is your child in school?” If a case of dropout is identified, it is recorded on the platform, triggering local teams to intervene and seek solutions. Thus, the project suggests the participation of public defenders in the management committees of the Active School Search in each municipality, strengthening coordination among various public and private stakeholders. With its 86 members and presence in all districts of Rondonia, the Public Defender’s Office can fill a gap identified by the State Court of Accounts regarding the shortage of community agents in the Active School Search, thereby expanding the system's reach and making its efforts to combat school dropout more effective. The relevance of the project lies in the need for public institutions to reinvent themselves, particularly in the face of contemporary challenges such as the use of digital technologies and the fulfillment of fundamental rights. The methodology of the study is qualitative, with a theoretical foundation based on the themes of school dropout, social rights, legal assistance, and mediation in the educational context, from an interdisciplinary perspective. The research also considers the use of digital technologies, such as the Active School Search platform, and the importance of interinstitutional cooperation in promoting more effective public policies in education. It is based on a case study in the municipality of Sao Miguel do Guapore, Rondonia, chosen for the socio-economic and educational challenges it faces, which reflects the reality of other regions in the state, allowing for a deeper analysis of the Public Defender's Office's role in combating school dropout. This includes interviews with public defenders, municipal administrators, teachers, and members of the school community, as well as an analysis of Active School Search data. Finally, the research evaluates the effectiveness of the platform in reducing school dropout and develops, as Product, a Manual de Implementacao do Programa Busca Ativa Escolar no Ambito da Defensoria Publica do Estado de Rondonia, guiding defenders on how to promote this action during their legal assistance sessions. This will make them key allies of municipal administrators in the fight against school dropout, contributing to enhance the role of the Public Defender’s Office and proposing a more efficient integration between educational public policies and legal assistance, ensuring the right to education for vulnerable populations, especially in the post-pandemic period.
