SUMMARY:

This research aims to study access to information as a human right based on the service provided by the Court of Justice of the State of Rondonia (TJRO). The objective was to analyze the scope and relevance of access to information on legal costs as a human right, from the perspective of public servants of the Judiciary of the State of Rondonia, as a way of guaranteeing faster and more efficient judicial provision. The methodology to be used will be a case study (YIN, 2015), as the focus is on Law no. 3,896/2016, which refers to the regulations that govern legal costs in the TJ/RO. The technique for obtaining data occurred through documentary research (GIL, 2010), as we used reports, tables, judicial provisions, TJ/RO legislation, which have not yet been subject to analytical treatment. Thus, from a reanalysis, aiming at a new interpretation or a complementary description, they will be able to bring solutions to the doubts and problems that have been arising in relation to legal costs in the TJ/RO. Within the framework of the theoretical framework we had authors such as Ayres (2022), Carvalho (2021), Costa (2021), Isaias (2021), Oliveira, Lucas and Chaves (2021), Torquato et al (2021), Lunardi (2020), Machado et al (2020), Barbosa, Almeida (2018), Lafer (2018) Faria e Silva (2017), legislation and others. Among the results, we highlight the need to update the current TJ/RO Costs Law, no. 3,896/2016, based on the number of doubts recorded in reports and other means. Among the most recurring doubts are those relating to payment, exemption and installments of legal costs (postponed, final, negligible, pending, pro rata, procedural costs, exemption from costs and gratuity), which are equivalent to 33.6% of the total. Thus, we conclude that it is essential to pre-establish a practice of systematizing answers to doubts as one of the ways to improve services related to legal costs provided to those under jurisdiction, as well as the continued training of TJ/RO employees on the topic and analysis on the feasibility of using Generative Artificial Intelligence.
