SUMMARY:

The vulnerability of victims of sexual abuse under the age of 14, as provided for in the 1940 Penal Code, has changed from relative to absolute (art. 227-A of the Penal Code), so those applying the law should stop observing the subjective criterion and analyze the specific case, to adopt the objective criterion, age. However, the Brazilian judiciary has been applying the subjective criterion in its judgments. In view of this, this research has the main objective of verifying the application of this legislative innovation in the justice system of Rondonia and demonstrating an overview of sexual crimes involving children in the State of Rondonia and especially in the capital Porto Velho, from 2019 to mid-2024. As a secondary objective, the research will verify the taxonomy of the processes in this period. The aim is also to present the legal history of the Protection Division of the Court of Justice and the 20th Public Prosecutor's Office of the Public Prosecutor's Office of the State of Rondonia, for sexual crimes within the human rights approach; in order to understand the legal developments and the preventive and active measures of the public agencies called upon to act in these crimes of rape of vulnerable people, including cases in riverside communities, quilombolas and indigenous reservations or their population. However, a question arises: Did the relativization of the vulnerability of the victim of rape of vulnerable people occur in the period mentioned? If so, in how many cases? In order to respond to this demand, this research will be developed in four moments: In the first moment, an overview of child violence in Brazil, in the North Region and in the State of Rondonia will be presented. The text then works on the collection of sensitive data and its protection; in the third moment, it seeks to give voice to the victims of sexual violence. After these presentations, a solution product will be proposed to the DHJUS. The joint action of the theoretical elaborations applied to the practical product will improve the storage, processing and analysis of data on child sexual abuse and consequently improve the promotion of public policies on the subject, providing greater protection for children and adolescents up to 14 years old, victims of sexual abuse. The topic addressed is linked to the line of research Human Rights and Foundations of Justice. It will use the bibliographic method and data analysis. It has an interdisciplinary nature and can be used as a reference, in addition to the area of Law, by Education, Psychology, Sociology and Social Work, since these areas of knowledge also deal directly with problems related to children and adolescents, victims of sexual abuse.
