SUMMARY:

This dissertation investigates the judicialization of land disputes involving Indigenous Lands in the state of Rondonia, focusing on strategic litigation as a tool for territorial claims. Using an interdisciplinary approach that combines law, history, and political science, the work analyzes how the judicial process can be appropriated by Indigenous peoples and their allies to pressure the State to conclude demarcation processes. Using the case study method, the study examines two public civil actions filed by the Federal Public Prosecutor's Office: the case of the Tanaru Indigenous Land and the case of the Wajuru Indigenous Land. The research reveals that, although the judicial process offers an institutional avenue for access to justice, it also imposes formal and temporal barriers that limit its effectiveness. Nevertheless, Indigenous legal mobilization represents a form of resistance and a reinterpretation of law as a technology of contestation.
