SUMMARY:

The growing litigation in Brazil has been registered by the various branches of Justice, among them the Special Civil Courts. Designed to overcome delays, it has been registering the increase of processes annually and, although they have been working under new perspectives, methodologies and process management, it has not had a positive impact in the scenario of hyperjudicialization and the increase in the lack of credibility by the user. in the Justice System. If, on the one hand, there is an increase in installed units, an increase in demands initiated year after year and an increase in productivity, how can one explain the meaning of the expression “access to justice” associated with “access to the judiciary” as a measure for the realization of rights, especially as a result of of the provisions of article 5, item XXXV, of the Federal Constitution against the meaning of access that turns its eyes to the service of the citizen with promptness and efficiency? Given this context, this research aims to understand to what extent the Special Courts contribute to access to justice and what can be improved, presenting as a case study the Special Court of the Comarca de Cacoal. We developed the research from a national parameter through the diagnoses that the National Council of Justice has been preparing, annually since 1996, and which makes it possible to measure data, objective indicators created and established to evaluate the performance of Courts in Brazil and with that measuring access to justice in this way, once designed to serve the less favored strata of society, is achieving this goal. Among them: lawsuits filed and filed, collection turnover time, productivity, cost of justice, among others. Based on the same indicators, we present data on the Special Court of Cacoal and evaluation of professional perception based on the jurisdictional conduct of the unit for more than 10 years. The advances identified in the last 25 years of the existence of the Special Courts in Brazil are undeniable, but the model needs to be improved, either by contributing to the monitoring of judicial management and/or by formulating public policies essential for the system in question to expand its scope. reach of Justice to the demands that, in essence, must be appreciated and decided and promote other already legitimized forms of conflict resolution and social pacification. The experience of conflicts, the way to go and the one actually traveled to satisfy these conflicts, is that we will emphasize in order to measure them in order to understand behaviors, perceptions and attitudes, suggesting the final product the creation of a tool compatible with technological advances to expose the litigant profile of the Special Civil Court of the District of Cacoal to be carried out through a hyperlink tool available on the official page of the Court of Justice of Rondônia. The creation and development can be used for administrative management and construction of public policies, containing questions that contribute to the formation of the profile of litigants and demands as exposed.
