Harassment and discrimination are severe forms of workplace violence that undermine the dignity, identity, and well-being of workers while negatively impacting institutional efficiency. Within the Judiciary, where equity and justice are fundamental values, the prevalence of such practices is alarming. Recent data, such as the National Survey on Harassment and Discrimination in the Judiciary (CNJ, 2022 and 2023), indicate that over 55% of respondents reported being victims of harassment or discrimination. In response, the National Council of Justice (CNJ) issued Resolution No. 351/2020, establishing the Policy for the Prevention and Combat of Moral Harassment, Sexual Harassment, and Discrimination in the Judiciary. In this context, the Court of Justice of Rondonia (TJRO) faces the challenge of implementing effective prevention and combat strategies, utilizing formalized complaints submitted to the Prevention and Combat Commissions for Harassment and Discrimination (CPCAD) of the 1st and 2nd Degrees, and adopting the philosophy and methodology of restorative justice.
This study aims to analyze harassment and discrimination in the workplace of TJRO by evaluating the incidence, types, and characteristics of complaints submitted to the CPCAD and proposing strategies based on restorative justice to address these issues. Additionally, the research seeks to conceptualize harassment and discrimination according to the literature and CNJ guidelines, identify victim and perpetrator profiles, and explore how restorative justice can be applied in the Judiciary context.
Methodologically, a qualitative and applied approach was adopted, emphasizing document analysis and literature review. Formalized complaints submitted to CPCAD of the 1st and 2nd Degrees were analyzed, adhering to the General Data Protection Law (LGPD) protocols, along with resolutions and internal regulations of TJRO. Content analysis, based on Bardin's principles (2009), was used to identify relevant patterns, trends, and categories. The research also drew on the works of renowned authors, such as Hirigoyen, Barreto, Zehr, and Pranis, to theoretically support discussions on harassment, discrimination, and restorative justice.
The results reveal that harassment and discrimination at TJRO reflect patterns found in other organizations, marked by hierarchy and authoritarianism. However, restorative justice emerges as an effective approach to mitigate these issues by fostering dialogue, accountability, and reparation. The study proposes guidelines for implementing restorative practices in CPCAD actions, aligned with CNJ Resolution No. 351/2020, and highlights the importance of transforming the organizational culture of TJRO.
The study concludes that adopting strategies based on restorative justice and effective institutional policies can significantly contribute to fostering a healthier, more inclusive work environment aligned with principles of equity and justice. This research underscores the urgency of institutionalizing responsibility for addressing harassment and discrimination in the Judiciary, offering insights for future initiatives and investigations
