TITLE: Human Rights and Anti-Discrimination Policies for LGBTQIA+ Workers: A Comparative Study between Two Public Institutions in Rondônia

SUMMARY: This research addresses human rights and anti-discrimination policies within the Tribunal de Justiça do Estado de Rondônia (TJ-RO) and Ministério Público do Trabalho da 14ª Região (MPT-14). It problematizes the underreporting of violence data, the precariousness of scientific research, and the absence of public policies for this population as representations of heterocoloniality in Rondônia. This heterocoloniality remains structured within public institutions and is practiced by their agents through institutional violence mechanisms, affecting work trajectories, mental health, and the existence of dissident individuals. The study considers the discrepancy between administrative practice and international legislation protecting equality and non-discrimination, along with the decent work paradigm of the International Labour Organization (ILO). It questions how the anti-discrimination policies of TJ-RO and the MPT-14 respond to the specificities of human rights violations against LGBTQIA+ workers in the Rondônia context. The overall objective is to compare the welcoming practices and promoting decent work in the two institutions. The relevance stems from the need to move from formal to material equality in public service, in addition to the existence of regulations from the TJ-RO aimed at joint inter-institutional action with MPT-14 in the pursuit of eliminating inequality. This is a qualitative, documentary, descriptive, and applied research study with a transformative perspective that uses reciprocal elucidation to rethink reality. Preliminary results point to a planned omission scenario, with the absence of employability policies, scarcity of government data, and insufficient punishment for aggressors; subalternation mechanisms, with heterocoloniality imposing Eurocentric moral standards, religious dogmas, and the cisheteronormativity naturalization, in addition to the dissident lives pathologization and abjection; social injustice, marked by the representation, recognition and redistribution denial; and performative self-discipline in the workplace, with silencing, symbolic disqualification, demands for compensatory professional effort, and permanent self-surveillance, positioning the LGBTQIA+ body as a dispute and control site. This study is expected to provide elements for rethinking dissent in public offices in the state, proposing as a technical product a Governance Protocol for Diversity and Institutional Care to improve the commissions' performance and avoid revictimization in discrimination complaints cases.
